Terms of Service

Please read these Terms carefully before using TutorAptly. They set out your rights and responsibilities when using our Service.
1. Acceptance of Terms
By accessing or using TutorAptly ("Service"), creating an account, or clicking "Get started", you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
2. Description of Service
TutorAptly provides an AI-powered SAT preparation platform. The Service includes: • Interactive Socratic tutoring across all 8 official SAT content domains • Progress tracking, XP and levelling system, boss battles, and daily challenges • Study analytics and projected score tracking • Adaptive timed practice sprints • Mistake Bank and daily study plans The Service is provided for educational and personal use only. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.
3. Account Registration
To access most features you must create an account. You agree to: • Provide accurate, current, and complete information during registration • Keep your password confidential and not share it with others • Notify us immediately at support@tutoraptly.com if you suspect unauthorised access to your account • Be responsible for all activity that occurs under your account You may not create more than one free account. Creating multiple accounts to circumvent usage limits is prohibited.
4. Acceptable Use
You agree not to: • Use the Service for any purpose that is unlawful or violates these Terms • Attempt to reverse-engineer, decompile, or extract source code from the Service • Scrape, crawl, or extract data from the Service using automated means • Share, resell, or sublicense your account access to others • Upload or transmit any content that is harmful, offensive, or infringes any third party's rights • Use the Service in a way that could damage, disable, or impair our infrastructure • Attempt to circumvent subscription limits by creating multiple accounts or other means • Misuse the AI tutoring feature for purposes unrelated to SAT preparation We reserve the right to suspend or terminate accounts that violate these rules.
5. Subscriptions, Billing, and Cancellation
Free plan
The Free plan is available at no charge with limited features as described on our pricing page. We may change or discontinue the Free plan at any time with 30 days' notice.
Paid plans (Scholar and Pro)
Paid subscriptions are billed monthly or annually in advance. Your subscription automatically renews unless you cancel before the renewal date. By subscribing, you authorise us to charge your payment method on a recurring basis.
Cancellation
You may cancel your subscription at any time from your account settings page. Cancellation takes effect at the end of your current billing period — you retain full access until then. We do not provide partial-period refunds.
Refunds
We offer a 7-day money-back guarantee on your first payment for any paid plan. If you are unsatisfied within 7 days of your first charge, contact us at billing@tutoraptly.com for a full refund. After 7 days, charges are non-refundable except where required by law.
Price changes
We may change subscription prices with at least 30 days' notice by email. Price changes will take effect at your next renewal. If you do not wish to accept the new price, you may cancel before your renewal date.
6. AI-Generated Content
The tutoring responses generated by Dash, our AI tutor, are produced by an AI model (Anthropic Claude) and are intended as educational guidance only. They are not a substitute for professional educational advice, and we make no warranty that responses are always accurate, current, or appropriate for every student. You are responsible for verifying any information you rely on from the Service, particularly in the context of preparing for a high-stakes exam.
7. Intellectual Property
All content on the Service, including but not limited to the interface design, graphics, logos, lesson structure, achievement system, and brand ("TutorAptly Content"), is owned by or licensed to us and protected by copyright and other intellectual property laws. Your licence: We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your own personal, non-commercial SAT preparation. This licence does not permit you to reproduce, distribute, or create derivative works from our Content. Your content: You retain ownership of any content you input into the Service (such as your answers and responses). You grant us a licence to use your input to provide and improve the Service.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, available at tutoraptly.com/privacy. By using the Service, you consent to the data practices described there.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that: • The Service will be uninterrupted, error-free, or secure • Any particular SAT score improvement will result from use of the Service • AI-generated tutoring responses will be accurate or appropriate in all cases Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third party's rights.
12. Termination
We may suspend or terminate your account at any time for breach of these Terms, with or without notice. You may terminate your account at any time by contacting support@tutoraptly.com or using the delete account option in your account settings. On termination, your licence to use the Service ends immediately. Sections 7, 9, 10, 11, and 13 survive termination.
13. Governing Law and Disputes
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New South Wales, Australia. If you are located in the United States or another jurisdiction, local consumer protection laws may grant you additional rights that cannot be waived by contract. We encourage you to contact us at support@tutoraptly.com before initiating any formal dispute — we will do our best to resolve issues fairly and promptly.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice in the app at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
